Terms and Conditions of Use of the Website
Article 1 – Definitions
Some of the definitions below are also set out in the FAQs. In the event of any discrepancy or difficulty in interpreting these definitions, it is expressly agreed that the definitions in the General Terms and Conditions of Use (‘GTC’) shall prevail.
Cookie: refers to a string of information that may be transmitted to the User’s browser by a website to which they connect. The web browser will store it for a certain period, depending on the nature of the cookie, and will send it back to the web server each time the User connects. Cookies are used, in particular, to store an identifier that enables the User’s browsing activity to be tracked for statistical purposes.
Personal data (or Data): means, in accordance with Article 4 of the General Data Protection Regulation of 27 April 2016 (GDPR), any information relating to an identified natural person or a natural person who can be identified, directly or indirectly, by reference to an identification number or to one or more factors specific to that person. To determine whether a person is identifiable, all means available to, or to which the data controller or any other person may have access, for the purpose of identifying that person, must be taken into account.
Intellectual property rights: refers to all intellectual property rights, including but not limited to copyright, software rights, database rights, patent rights, rights in inventions, rights in trade marks, distinctive marks, design rights, semiconductor topography rights, trade secrets and know-how.
Hyperlink: means an element added to the content of a web page which, with a single click, allows access to other content, whether on the same site (internal) or on a third-party site (external).
Site: refers to the Hello Paris SERVICES showcase website, accessible via the URL https://www.cdgexpress.com, which enables internet users to discover the services offered by CDG Express.
User: refers to an internet user, i.e. the individual visiting the Website.
Article 2 – Intellectual Property
All rights reserved. CDG Express is a registered trademark of Hello Paris Services, the publisher of the Website. The Website (comprising all accessible information, in particular in the form of text, photographs, images, sound, data and databases) is protected by intellectual property rights and/or other rights held by CDG Express or which it is authorised to use. The User has no intellectual property rights over the Website or its content. Any reproduction, in whole or in part, of this trade mark and its logo for any purpose whatsoever, and in particular for advertising purposes, without the prior written consent of the trade mark owner is prohibited and may result in legal proceedings.
Under no circumstances may the User store, reproduce, display, modify, transmit, publish, adapt on any medium whatsoever, by any means whatsoever, or exploit in any way whatsoever, the elements of the Website without the prior written authorisation of CDG Express.
Article 3 – Website security
The User undertakes to inform CDG Express without delay, by any means, of any error, fault or irregularity they may notice whilst using the Website, as soon as they become aware of it.
The User undertakes not to attempt to modify the headers or to manipulate the pages of the Website in such a way as to conceal, misrepresent or alter the Website. It is also prohibited to create a work or website derived from all or part of this Website, or to resell or redistribute CDG Express’s data.
It is strictly prohibited: (i) to use and/or access the Website for purposes other than those provided for in these Terms of Use; (ii) to reproduce, modify, adapt or alter the Website and/or its content; (iii) to create derivative works thereof; (iv) to access or attempt to access the Website’s source code, whether by means of decompilation, reverse engineering or any other method whatsoever; (v) to make parts of the Website or the Content to which access is restricted available to third parties. The User undertakes not to breach any legal provisions or to use the Website for any unlawful purpose, not to include any false, incomplete or inaccurate information, and not to include any viruses, Trojan horses, worms, time bomb or any other programme designed to damage, cause harm to, intercept or interfere with any system, data or personal information.
Article 4 – External hyperlinks
Hyperlinks to other websites or other sources of information provided on the Website are published and/or managed by third parties, with a view to enhancing the relevance of the User’s browsing experience. As the Site’s publisher is unable to control the content of these external sources, the User acknowledges that the publisher accepts no liability in relation to the provision of these resources, their content, any collection and transmission of personal data, the setting of cookies or any other process serving the same purposes and carried out by these websites.
The User acknowledges that any hyperlink on the Website to another website does not constitute a recommendation or endorsement of that website or its content, unless the specific terms and conditions of the service provided to the registered User specify otherwise. It is the User’s responsibility to use this information with discernment and a critical mind.
Article 5 – Protection of personal data
Personal data relating to Users of the Website is collected and processed by Hello Paris Services in its capacity as data controller. This data is necessary for the technical management of the Website (management of the Website’s operation and security), for carrying out audience measurement for the Website, and for managing the contact form. These processing activities relating to personal data (purposes, legal bases, recipients, data retention periods, etc.) are fully set out in our data protection policy, which is available on the Website.
The User’s rights are: the right of access, rectification, erasure and data portability; the right to withdraw consent at any time; the right to object to the processing of data; the right to restrict processing; the right to lodge a complaint with the CNIL, and the right to set out instructions in the event of death. Article 6 – Cookies and other trackers
Cookies necessary for the functioning of the Website are placed and read on the Website. They cannot be disabled.
Article 7 – Liability
CDG Express undertakes to use all means at its disposal to ensure the proper functioning of the Website. It shall not be held liable in the event of force majeure, the actions of a third party or any event beyond its control.
CDG Express makes every effort to provide services that are available and verified, but cannot guarantee the accuracy, completeness or timeliness of the information accessible on the Website.
Article 8 – Applicable Law – Dispute Resolution
In the event of a dispute relating to the interpretation, formation, validity or performance of these Terms of Use or the use of the Website, CDG Express and Users expressly acknowledge that French law shall apply exclusively.
In the absence of an amicable settlement, in the event of a dispute relating to the interpretation, formation, validity or performance of the Terms of Use, and failing to reach an agreement or a settlement, CDG Express and the Users expressly and exclusively submit to the jurisdiction of the competent courts within the jurisdiction of the Paris Court of Appeal, notwithstanding multiple defendants, summary proceedings, third-party proceedings or interim measures. In the event of a failure to comply with the obligation to attempt an amicable resolution of the dispute – which remains the responsibility of the User – CDG Express shall not be held liable in this respect.
